Hon'ble Mr.Justice K.G.Balakrishnan, Chief Justice of India, is the Patron in Chief and Mr. Justice Y.K. Sabharwal, former Chief Justice of India, is APJA's Founder Patron. It is headed by Mr.Justice Vijender Jain (President), Chief Justice of Punjab & Haryana High Court. He is supported by Mr. Justice Anil Kumar, Mr. Justice Kailash Gambhir, Mr.Justice P.K.Bhasin, Mr. Justice S.N.Aggarwal and Mr. Justice Hima Kohli & Mr. Justice Sidharth Mridul of Delhi High Court and Mr.Justice Suryakant and Mr. Justice Rajesh Bindal of the High court of Punjab & Haryana. They are further supported by Mr.Amarjit Singh Chandhiok, as Senior Vice-Presidents, who is a distinguished senior lawyer and a former President of Delhi High Court Bar Association. The other Vice-Presidents of the Association are Mr. Anil Sapra and Mr. Ravi Kant Chadha Seniro Adovate, two leading lawyers in the High Court of Delhi. Mr. Pradeep K. Bakshi, a lawyer, is the Secretary. Mr. Jugal Wadhwa, a lawyer, is another Secretary.
APJA'S principle role is to provide a forum to members of legal profession and associated fields in the Asian Pacific Region to meet, interact, co-operate and share their experiences and provide insight into the different legal systems with a view to promote the region for maximum utilization of its resources and achieving sustainable economic development.
APJA has a specific interest in environmental laws and their enforcement with particular reference to the Asian Pacific Region. With the advancement of industrial development and fast economic growth in the Region, it has become imperative that the people in Asian Pacific Region work closely to meet the resultant challenges being thrown up on account of the haphazard, random and unorganized development in the Region and the awareness among the public on risk management in matters spanning the spectrum of environmental aspects and emergency planning to conserve the environment and natural resources and encourage “green” or “sustainable” development.
APJA is both, policy and practice oriented. It is an advocacy-type organization with the objectives of synergising the legal system of the Region to recommend and initiate measures for the removal of obstacles in the implementation of different laws and ensuring their compliance. It is its endeavour to stimulate concern for the environment and simultaneously strengthen the ties among the legal fraternity of the Region. At the outset itself APJA recognized that the key to create awareness towards sustainable and healthy economic growth in the Region is to encourage dialogue among lawmakers, legal practitioners, and educators of the Asian Pacific Region. Such interactions will lead to more creative and innovative solutions to problems of the Region.
Likewise, APJA would initiate and encourage dialogues and deliberations emphasizing the need for supporting the process of liberalization, trade and investment facilitation programmes to promote the flow of goods, services and capital movement within the Region. It would attempt to collective generation of ideas and opinions to promote trade and industry, without losing sight of the fact that consumers too have the right to enjoy the benefits. Intellectual Property Rights law is, of course an area with considerable overlap with other areas of law and practice. At APJA, intellectual property rights protection in India but of the Region is of paramount importance. With information technology expanding by leaps sand bounds, joint ventures, foreign direct investments (FDI) directly involve the elements of intellectual property in terms of trademarks, rights of users and licensing and thus targeting educative measures, academic and institutional brainstorming for liberalized trade and business, protection of intellectual property rights is in the forefront of its agenda.
With the increased pace of trade and industrial development globally and in the Region, disputes and differences have also increased manifold. APJA would advocate, promote and popularize expeditious disposal of disputes through a common informal forum chosen by the parties i.e. Alternative Disputes Resolution which takes into consideration the relevant laws of different legal systems of the Region.
APJA had organized a A seminar on the effects of change of Patents Laws in India pursuant to coming in force of Patents Act, 2005. The then Chief Justice of India Hon'ble Justice R.C. Lahoti was the Chief Guest and Sh. H.R. Bhardwaj, Minister for Law and Justice, was the Guest of Honour. Amongst the many eminent Speakers were, Hon'ble Justice Y.K. Sabharwal, Justice Vijender Jain and Mr. Habil Khorakiwala, Chairman, M/s. Wochhardt Ltd.
Another three day international conference on 'Awareness as a tool of Enforcement of Environment Laws was also organized at Delhi. The Conference was inaugurated by His Excellency, the President of India, Dr. APJ Abdul Kalam, in the presence of the then Chief Justice of India and our Patron-in-Chief, Hon'ble Y.K. Sabhawal, Minister for Law and Justice H.R. Bhardwaj, Minister for Environment & Forests, Mr. A. Raja and other eminent and distinguished Guest. The partners for this Conference, amongst others, were the World Bank, United Nations Environment Programme (UNEP), Ministry of Environment & Forests, Govt. of India, Govt, of NCT of Delhi, Maharashtra Pollution Control Board. The highlight of the conference was a solemn pledge administered by the Hon'ble President to the entire gathering, including over 3000 students from various schools
APJA has launched its Punjab & Haryana Chapter of APJA at Chandigarh with seminar of Environment Law. It was inaugurated by Hon'ble Justice Vijender Jain, President of APJA and Chief Justice of Punjab & Haryana High Court. Vice Chancellor of Punjab University was the keynote Speaker, Justice Surya Kant is the President of Punjab & Haryana Chapter with Justice Rajest Bindal its Vice President. Inauguration session was attended by over 300 members including Judges, Lawyers and Academicians.
APJA is founder member of Asian Environment Compliance and Enforcement Network (AECEN), Regional Practitioners Network of National and Sub-National Agencies from Asian countries committed to improve the Environmental Compliance and Enforcement in Asia. Justice Vijender Jain, President of APJA, the keynote Speaker at its inaugural session held in Bangkok in October, 2004, where Mr. A.S. Chandhiok, Senior Vice President of APJA was also a Speaker. Mr. Pradeep K. Bakshi, Sefcretary General and Mr. Anil Sapra, Vice President also represented APJA inauguration session. Justice Jain was also a founder member of the Executive Committee of AECEN.
APJA was also invited by The Environmental Conference & Enforcement Network for Accession (ECENA) at its workshop of Benchmarking and Setting Environmental Compliance and Enforcement Indicators held at Szentendra, Hungary in March, 2007, which was attended by Shri Pradeep K. Bakshi, Secretary, as representative of APJA. On account of APJA's participation, a proposal for starting APJA-ECENA Environmental Forum has been initiated for working together, understanding each others judicial system and exchange of views and experiences in the field of environment.
The above description is a brief outlook of the ways in which APJA seeks to build, block by block, the foundation for a system or law that will ensure increased interaction amongst the legal fraternities of the Region thus, resulting in the realization of the objectives of APJA. This is an on-going effort, and APJA is committed to its continuation to ensure a clean, green and healthy environment for the mankind and all generations to come. |
